Ada banyak jenis cybercrime yang terjadi di dunia global dan beberapa di antaranya telah sering terjadi di Indonesia.

merupakan tindakan memasukkan data dan atau informasi ke dalam internet yang dianggap tidak benar, tidak etis dan melanggar hukum atau mengganggu ketertiban umum.

Salah satu contoh illegal content yang sering ditemui adalah dalam bidang pornografi (cyberporn). Cyberporn itu sendiri merupakan kegiatan yang dilakukan dengan membuat, memasang, mendistribusikan dan menyebarkan material yang berbau pornografi, cabul dan mengekspos hal-hal yang tidak pantas.

Cybertrespass di Indonesia

Pelaku kejahatan memasuki jaringan komputer tanpa adanya otoritas atau wewenang tetpi tidak menyalahgunakan atau merusak data dijaringan komputer tersebut.pelaku cybertrespass senang mengintip dan membaca email pribadi dan dokumen ornglain.pelaku gemar mengamati program yang ada disistem komputer orang lain dan diwebsite yang dikunjngi orang lain, walaupun tidak dapat dibuktikan adanya kerusakaan atau kerugian,pelaku cybertespass dapat dikenakan tindak pidana karena telah memasuki suatu system komputer tanpa izin  pemilik.

Joycomputing adalah seseorang yang menggunakan komputer secara tidak sah/tanpa izin, dan mempergunakannya melampaui wewenang yang diberikan. Istilah joycomputing diambil dari pendapat N.Keyser dalam ceramahnya tentang hukum pidana belanda dan penyalahguanaan komputer di BPHN Jakarta. Joycomputing mengingatkan orang pada joyriding yaitu memakai mobil orang lain tanpa izin untuk bersenang-senang setelah itu dikembalikan kembali. Jadi joycomputing dapat diartikan sebagai perbuatan seseorang memanfatkan waktu penggunan komputer (mencuri waktu pengguna atau pelayannan komputer) secara tidak sah untuk kepentingan pribadi atau kelompoknya pada saat dinas.

Cyber Trespass

What is Cyber Trespass ?

The word “trespass” in general means to enter into the other’s property without seeking consent. It is considered a civil wrong ordinarily. If the trespass is committed with criminal intention it is called criminal trespass. To protect an owner’s control over the property the trespass actions are stranded. The websites should also be considered a species of property. The concept of trespass is applicable in cases of the cyber world and may be termed as Cyber Trespass. The act of hacking by the hacker is of civil nature, but if the intention to harm or damage the system is proved, the liability is of penal nature.

The hacking may also result in other crimes mentioned in the Indian Penal Code 1860 apart from criminal trespass. For example if a hacker hacks into the Information Technology Act tries to the website of a bank and transfers money into his account this may constitute a crime under Section 378 of the Indian Penal Code 1860. The act in the above case can also be termed as Cyber Theft. The Information Technology Act provides civil and penal consequences for hacking and other wrongful activities.

Cybercrime is any criminal activity involving computers and networks. It can range from fraud to spam to the distant theft of government or corporate secrets through criminal trespass into remote systems, even in other countries or on other continents.

Lawmakers, law enforcement, and individuals need to know how to protect themselves and the people for which they are responsible. The only difference involves the tools used to commit the crimes.

*  Assault by Threat – threatening a person with fear for their lives or the lives of their families or persons whose safety they are responsible for (such as employees or communities) through the use of a computer network such as email, videos, or phones.
